Legal Framework
Legislation provides a powerful framework for the Luxembourg ICT sector and other electronic activities.
Luxembourg was for instance the first European country to implement the European directives relating to electronic signatures and e-commerce. In November 2005, the government of Luxembourg and several key players from the private sector founded LuxTrust S.A. in order to create a national digital certification platform using a public key infrastructure (PKI).
Luxembourg also offers business effective data protection laws. While originally aimed at the financial sector, these laws nowadays also apply to electronic data processing activities.
The Luxembourg regulation is generally based on the principles of open markets, country of origin regulation and free circulation of services.
According to the Heritage Foundation, "The overall freedom to start, operate, and close a business is relatively well protected by Luxembourg's regulatory environment. Starting a business takes about half the world average of 43 days".
Legal stability is considered as very important, allowing companies to enjoy foreseeability for the medium and the long term.
